1. ลักษณะของบริการ

NICKNAME.click เป็นเกม/กระดานจัดอันดับ เพื่อความบันเทิงเท่านั้น ไม่มีวัตถุประสงค์ทางการลงทุน การพนัน หรือประโยชน์อื่นใด "คะแนน" เป็นเพียงตัวเลขในเกม ไม่มีมูลค่าทางการเงิน ไม่สามารถถอน แลกเปลี่ยน โอน ซื้อขาย หรือเรียกร้องเป็นเงิน/ทรัพย์สินใด ๆ ได้

2. เนื้อหาที่ผู้ใช้สร้าง (ชื่อ/รูปภาพ)

ผู้ใช้ รับผิดชอบแต่เพียงผู้เดียว ต่อชื่อ ข้อความ และรูปภาพที่ตนอัปโหลด
ห้ามอัปโหลดเนื้อหาที่ผิดกฎหมาย ลามกอนาจาร หมิ่นประมาท ละเมิดลิขสิทธิ์ หรือละเมิดสิทธิผู้อื่น
เรามีสิทธิ์ ลบ แก้ไข ซ่อน หรือรีเซ็ต ชื่อ/รูป/คะแนนใด ๆ ได้ทุกเมื่อ โดยไม่ต้องแจ้งล่วงหน้าและไม่ต้องให้เหตุผล
เราไม่รับรอง ไม่ตรวจสอบ และไม่รับผิดชอบต่อเนื้อหาที่ผู้ใช้สร้างขึ้น

ชื่อ ข้อความ และรูปภาพทั้งหมดที่ปรากฏบนบริการ ถูกสร้างและอัปโหลดโดยผู้ใช้ มิใช่โดยผู้ให้บริการ ผู้ให้บริการทำหน้าที่เป็นเพียง ตัวกลางทางเทคนิค (intermediary/hosting platform) เท่านั้น และ ไม่มีส่วนเกี่ยวข้อง ไม่รับรอง ไม่ตรวจสอบล่วงหน้า และไม่รับผิดชอบใด ๆ ทั้งสิ้น ต่อชื่อหรือรูปภาพที่ผู้ใช้ตั้งหรือใช้ ไม่ว่าเนื้อหานั้นจะมีลิขสิทธิ์ เครื่องหมายการค้า สิทธิในความเป็นส่วนตัว สิทธิในชื่อเสียง หรือสิทธิอื่นใดของบุคคลภายนอกหรือไม่ก็ตาม

2.1 การรับรองด้านลิขสิทธิ์/สิทธิของบุคคลภายนอก

ผู้ใช้ รับรองและรับประกัน ว่าตนเป็นเจ้าของสิทธิ หรือได้รับอนุญาตโดยชอบด้วยกฎหมายให้ใช้ชื่อและรูปภาพที่อัปโหลด และการอัปโหลดดังกล่าวไม่ละเมิดลิขสิทธิ์ เครื่องหมายการค้า ความเป็นส่วนตัว ชื่อเสียง หรือสิทธิใด ๆ ของบุคคลอื่น
บรรดาความรับผิดทั้งทาง แพ่งและอาญา ที่เกิดจากชื่อหรือรูปภาพที่ผู้ใช้อัปโหลด ตกเป็นของผู้ใช้แต่เพียงผู้เดียว ผู้ใช้ตกลงรับผิดชอบและชดใช้ค่าเสียหายแทนผู้ให้บริการทั้งหมด (ดูข้อ 6)
การแจ้งเพื่อนำออก (Notice & Takedown): หากท่านเป็นเจ้าของสิทธิและพบว่ามีการละเมิด โปรดแจ้งผ่านช่องทาง "ติดต่อเรา" เราจะพิจารณานำเนื้อหาที่ถูกรายงานออกภายในเวลาอันสมควร ทั้งนี้ การนำออกไม่ถือเป็นการยอมรับความรับผิดของผู้ให้บริการแต่อย่างใด
ผู้ให้บริการไม่มีหน้าที่คัดกรองเนื้อหาล่วงหน้า และไม่ถือเป็นผู้เผยแพร่ (publisher) เนื้อหาของผู้ใช้

3. การชำระเงินและคะแนน (Boost)

ทุกการชำระเงินถือเป็นที่สิ้นสุดและไม่มีการคืนเงินทุกกรณี (non-refundable) รวมถึงแต่ไม่จำกัดเพียง การกรอกชื่อผิด การจ่ายผิด การเปลี่ยนใจ คะแนนถูกรีเซ็ต ชื่อถูกลบ หรือบริการหยุดให้บริการ
ท่านมีหน้าที่ตรวจสอบชื่อที่จะดันอันดับและจำนวนเงินให้ถูกต้อง ก่อน ชำระเงินทุกครั้ง
การชำระเงินทำผ่าน QR พร้อมเพย์ (โอนเข้าบัญชีผู้ให้บริการโดยตรง) และยืนยันด้วยการอัปสลิป ซึ่งตรวจสอบโดยบริการภายนอก (slip2go) — เราไม่จัดเก็บข้อมูลบัตรเครดิต/เดบิต
คะแนนที่ได้จากการชำระเงินอาจสูญหายได้หากมีการรีเซ็ต/ล้างกระดาน ซึ่งเป็นการใช้งานปกติของเกม และ ไม่ก่อให้เกิดสิทธิเรียกร้องคืนเงินหรือค่าเสียหายใด ๆ

4. บริการ "ตามสภาพ" และไม่มีการรับประกัน

บริการให้ "ตามสภาพที่เป็นอยู่" (AS IS) และ "เท่าที่มีให้บริการ" โดยไม่มีการรับประกันใด ๆ ทั้งโดยชัดแจ้งหรือปริยาย เราไม่รับประกันความถูกต้องของอันดับ/คะแนน ความต่อเนื่อง หรือความปลอดภัย และอาจ เปลี่ยนแปลง ระงับ หรือยุติบริการ ทั้งหมดหรือบางส่วนได้ทุกเมื่อโดยไม่ต้องแจ้งล่วงหน้า

5. ข้อจำกัดความรับผิด

เท่าที่กฎหมายอนุญาตสูงสุด NICKNAME.click ผู้พัฒนา เจ้าของ และผู้เกี่ยวข้อง จะไม่รับผิดชอบต่อความเสียหายใด ๆ ทั้งสิ้น ไม่ว่าทางตรง ทางอ้อม โดยบังเอิญ พิเศษ หรือเป็นผลสืบเนื่อง อันเกิดจากหรือ เกี่ยวข้องกับการใช้บริการ — รวมถึงแต่ไม่จำกัดเพียง ชื่อ คะแนน รูปภาพ และจำนวนเงินที่ท่านชำระเข้ามา การสูญหายของข้อมูล การถูกลบ/รีเซ็ต การหยุดให้บริการ หรือการกระทำของผู้ใช้รายอื่น

ในทุกกรณี ความรับผิดรวมสูงสุดของเรา (หากมี) จะไม่เกินจำนวนเงินที่ท่านชำระจริงในรายการที่เป็นเหตุพิพาทนั้น ๆ เท่านั้น

6. การชดใช้ค่าเสียหาย

ท่านตกลงจะปกป้องและชดใช้ค่าเสียหายแก่เรา จากข้อเรียกร้อง ความสูญเสีย หรือค่าใช้จ่าย (รวมค่าทนายความ) อันเกิดจากการที่ท่านใช้บริการ ละเมิดข้อกำหนดนี้ หรือละเมิดสิทธิของบุคคลอื่น

7. คุณสมบัติผู้ใช้และการใช้งานที่ยอมรับได้

ท่านรับรองว่าบรรลุนิติภาวะหรือได้รับความยินยอมจากผู้ปกครอง และใช้บัตร/บัญชีชำระเงินของท่านเองโดยชอบด้วยกฎหมาย ท่านตกลงจะ ไม่:

ใช้บอท สคริปต์ หรือวิธีอัตโนมัติเพื่อกดคะแนน/สร้างชื่อจำนวนมาก หรือหลบเลี่ยงระบบจำกัดอัตรา
ปลอมแปลงตัวตน แอบอ้างบุคคลอื่น หรือใช้ข้อมูลการชำระเงินของผู้อื่นโดยไม่ได้รับอนุญาต
เจาะระบบ รบกวน หรือทำให้บริการเสียหาย
ใช้บริการเพื่อการพนัน ฟอกเงิน หรือกิจกรรมที่ผิดกฎหมายอื่นใด

8. การระงับและปฏิเสธการให้บริการ

เราขอสงวนสิทธิ์ในการ ระงับ ปฏิเสธ หรือยุติ การให้บริการแก่ผู้ใช้รายใดก็ได้ ลบชื่อ/คะแนน และริบคะแนนที่ได้มาโดยทุจริต ได้ทุกเมื่อ ตามดุลพินิจของเราแต่เพียงผู้เดียว โดยไม่ต้องแจ้งล่วงหน้าและไม่ต้องรับผิดหรือคืนเงินใด ๆ

9. การโต้แย้งการชำระเงิน (Chargeback)

การ "boost" เป็นบริการดิจิทัลที่ส่งมอบทันที การยื่นโต้แย้ง/ขอคืนเงิน (chargeback) โดยไม่สุจริต ถือเป็นการผิดข้อกำหนดนี้ เราขอสงวนสิทธิ์ระงับการใช้งาน ริบคะแนน และดำเนินการตามกฎหมายเพื่อเรียกค่าเสียหายและค่าธรรมเนียมที่เกี่ยวข้อง

10. ความเป็นส่วนตัว (PDPA)

เราเก็บข้อมูลเท่าที่จำเป็นต่อการให้บริการและป้องกันการโกง (เช่น ค่าระบุอุปกรณ์แบบเข้ารหัส) โดย ไม่มีระบบบัญชีผู้ใช้ และไม่จัดเก็บประวัติการใช้งานรายบุคคลในระยะยาว — ดูรายละเอียดใน นโยบายความเป็นส่วนตัว

11. ทรัพย์สินทางปัญญาของผู้ให้บริการ

เครื่องหมาย ดีไซน์ และซอฟต์แวร์ของเว็บไซต์เป็นของเรา ห้ามทำซ้ำหรือนำไปใช้โดยไม่ได้รับอนุญาต (ทั้งนี้ไม่รวมเนื้อหาที่ผู้ใช้อัปโหลด ซึ่งเป็นความรับผิดชอบของผู้ใช้ตามข้อ 2)

12. เหตุสุดวิสัย

ผู้ให้บริการไม่ต้องรับผิดต่อความล่าช้าหรือการไม่สามารถให้บริการได้ อันเกิดจากเหตุที่อยู่นอกเหนือการควบคุมตามสมควร เช่น ระบบเครือข่าย/โฮสติ้ง/ผู้ให้บริการชำระเงินขัดข้อง ภัยธรรมชาติ หรือการกระทำของบุคคลภายนอก

13. กฎหมายที่ใช้บังคับ

ข้อกำหนดนี้อยู่ภายใต้กฎหมายแห่งราชอาณาจักรไทย ข้อพิพาทให้อยู่ในเขตอำนาจของศาลไทย

14. ข้อตกลงเบ็ดเตล็ด

การแยกส่วน: หากข้อใดเป็นโมฆะหรือบังคับใช้ไม่ได้ ให้ข้ออื่น ๆ ยังคงมีผลสมบูรณ์ต่อไป
การไม่สละสิทธิ: การที่เราไม่ใช้สิทธิข้อใด ไม่ถือเป็นการสละสิทธินั้น
การโอนสิทธิ: เราอาจโอนสิทธิและหน้าที่ตามข้อกำหนดนี้ให้บุคคลอื่นได้ ผู้ใช้โอนไม่ได้เว้นแต่ได้รับความยินยอม
ข้อตกลงทั้งหมด: ข้อกำหนดนี้ถือเป็นข้อตกลงทั้งหมดระหว่างท่านกับผู้ให้บริการเกี่ยวกับการใช้บริการ

15. การแก้ไขข้อกำหนด

เราอาจแก้ไขข้อกำหนดนี้ได้ทุกเมื่อ การใช้บริการต่อไปหลังการแก้ไขถือว่าท่านยอมรับข้อกำหนดฉบับใหม่

Please read carefully — by accessing the site, adding a name/image, clicking points, or making any payment, you accept all of these Terms & Conditions. If you do not accept them, please stop using the service immediately.

1. Nature of the service

NICKNAME.click is a ranking game/leaderboard for entertainment only, with no investment, gambling, or other purpose. "Points" are merely in-game numbers with no monetary value and cannot be withdrawn, exchanged, transferred, sold, or claimed as money/property of any kind.

2. User-generated content (names/images)

The user is solely responsible for the names, text, and images they upload.
Do not upload content that is illegal, obscene, defamatory, copyright-infringing, or that violates others' rights.
We may delete, edit, hide, or reset any name/image/score at any time, without prior notice and without giving reasons.
We do not endorse, vet, or take responsibility for user-generated content.

All names, text, and images appearing on the service are created and uploaded by users, not by the provider. The provider acts solely as a technical intermediary / hosting platform and is not involved in, does not endorse, does not pre-screen, and bears no responsibility whatsoever for any name or image set or used by users — whether or not such content is subject to copyright, trademark, privacy rights, publicity rights, or any other rights of third parties.

2.1 Warranty regarding third-party rights / copyright

The user represents and warrants that they own the rights to, or are lawfully permitted to use, the names and images they upload, and that such upload does not infringe the copyright, trademark, privacy, publicity, or any other rights of any other person.
All civil and criminal liability arising from a user's uploaded name or image rests solely with that user, who agrees to be responsible for and to indemnify the provider in full (see clause 6).
Notice & Takedown: if you are a rights holder and find an infringement, please notify us via "Contact us". We will consider removing the reported content within a reasonable time. Such removal does not constitute any admission of liability by the provider.
The provider has no duty to pre-screen content and is not the publisher of user content.

3. Payments and points (Boost)

All payments are final and non-refundable in all cases, including but not limited to: entering the wrong name, paying the wrong amount, change of mind, points being reset, names being deleted, or the service being discontinued.
It is your responsibility to verify the name to be boosted and the amount before every payment.
Payments are made via PromptPay QR (transferred directly to the provider's account) and confirmed by uploading a slip, which is verified by a third-party service (slip2go) — we do not store any credit/debit card data.
Points obtained from payment may be lost if a reset/board wipe occurs, which is normal game operation and gives rise to no claim for any refund or damages.

4. "AS IS" service and no warranty

The service is provided "AS IS" and "as available", without any warranty, express or implied. We do not warrant the accuracy of rankings/scores, continuity, or security, and may change, suspend, or terminate the service in whole or in part at any time without prior notice.

5. Limitation of liability

To the maximum extent permitted by law, NICKNAME.click, its developers, owners, and affiliates shall not be liable for any damages whatsoever, whether direct, indirect, incidental, special, or consequential, arising from or related to use of the service — including but not limited to names, points, images, and amounts you have paid, loss of data, deletion/reset, service interruption, or the actions of other users.

In any event, our total maximum liability (if any) shall not exceed the amount you actually paid in the specific disputed transaction.

6. Indemnification

You agree to defend and indemnify us against any claims, losses, or expenses (including legal fees) arising from your use of the service, your breach of these Terms, or your infringement of others' rights.

7. Eligibility and acceptable use

You represent that you are of legal age or have parental consent, and that you use your own payment card/account lawfully. You agree not to:

use bots, scripts, or automated means to click points / create names in bulk, or to circumvent rate limits;
impersonate others, or use another person's payment information without authorization;
hack, disrupt, or damage the service;
use the service for gambling, money laundering, or any other illegal activity.

8. Suspension and refusal of service

We reserve the right to suspend, refuse, or terminate service to any user, delete names/scores, and forfeit fraudulently obtained points at any time, at our sole discretion, without prior notice and without liability or any refund.

9. Chargebacks

A "boost" is a digital service delivered immediately. Filing a dispute/refund (chargeback) in bad faith is a breach of these Terms. We reserve the right to suspend access, forfeit points, and take legal action to recover damages and related fees.

10. Privacy (PDPA)

We collect only data necessary to provide the service and prevent fraud (e.g., a hashed device identifier), with no user accounts and no long-term per-user activity history — see our Privacy Policy.

11. Provider's intellectual property

The site's marks, design, and software belong to us and may not be copied or used without permission (this excludes user-uploaded content, which is the user's responsibility under clause 2).

12. Force majeure

The provider is not liable for delays or inability to provide the service due to causes beyond its reasonable control, such as network/hosting/payment-provider failures, natural disasters, or acts of third parties.

13. Governing law

These Terms are governed by the laws of the Kingdom of Thailand, and disputes are subject to the jurisdiction of the Thai courts.

14. Miscellaneous

Severability: if any clause is void or unenforceable, the remaining clauses remain in full effect.
No waiver: our failure to exercise any right is not a waiver of that right.
Assignment: we may assign our rights and obligations under these Terms; users may not assign without consent.
Entire agreement: these Terms constitute the entire agreement between you and the provider regarding use of the service.

15. Changes to these Terms

We may amend these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.
